[01] Communication sur les mesures correctrices dans les affaires de
concentration: quand et comment rem�dier aux probl�mes de position
dominante
La Commission europ�enne a adopt� une communication sur les mesures
correctrices acceptables pour r�soudre les probl�mes de concurrence
soulev�s par les fusions et acquisitions. Elle a pour objectif de donner
aux entreprises et au monde juridique un certain nombre d'orientations sur
la politique pratiqu�e par l'Union europ�enne en mati�re de contr�le des
concentrations, et de rendre ainsi cette politique plus pr�visible. Elle
repose sur dix ans d'application du r�glement sur les concentrations.
[02] Commission fines JCB for unlawful distribution agreements and
practices
The European Commission has adopted a decision finding that JC Bamford
Group (JCB) of Britain, a leading manufacturer of construction, farm and
industrial handling equipment, has violated European Union antitrust law.
Since the late 80s, JCB has put in place distribution agreements and other
practices which have the effect of severely restricting out of territory
sales of JCB's products both within certain national territories and across
national borders, as well as interfering with the freedom to set resale
prices. For these very serious violations of article 81 of the EC treaty
JCB was fined a total euro 39.6 million.
[03] La Commission adopte une d�cision sur base de l'article 86 �3 relative
� la prestation en Italie de nouveaux services postaux
La Commission europ�enne a adopt� une d�cision relative � la prestation en
Italie des nouveaux services postaux qui offrent une s�rie de prestations �
valeur ajout�e, notamment la garantie que l'envoi cr�� �lectroniquement
arrive � une date ou � une heure certaine. La Commission estime que le
d�cret l�gislatif italien n�261 du 22 juillet 1999 qui �tablit cette
r�servation contrevient � l'article 86 �1 en liaison avec l'article 82 du
Trait�. Cette d�cision fait suite a une plainte d�pos� � l'encontre de
l'Etat italien concernant la r�servation au profit de l'op�rateur
historique de la phase de livraison du courrier hybride (courrier dans
lequel les envois postaux sont g�n�r�s par des moyens �lectroniques). Cette
r�servation emp�che les fournisseurs priv�s de fournir le courrier hybride
dans son int�gralit�. Aucun Etat Membre mis � part l'Italie n'a r�serv� la
phase de livraison du courrier hybride � une date ou � une heure certaine �
l'op�rateur historique.
[04] La Commission propose des mesures de lutte contre la traite des �tres
humains et l'exploitation sexuelle des enfants
La Commission europ�enne a propos� un train de mesures pour lutter contre
la traite des �tres humains et l'exploitation sexuelle des enfants, comme
l'avaient demand� les dirigeants europ�ens au sommet de Tampere. La
communication d'aujourd'hui trace les contours d'une strat�gie globale
permettant de faire face � ces menaces graves et croissantes. Parall�lement,
la Commission pr�sente deux propositions de d�cisions-cadres relatives au
rapprochement des l�gislations nationales en mati�re de droit p�nal et aux
proc�dures p�nales. Ces d�cisions-cadres fourniront un haut degr� de
protection l�gale aux enfants et aux victimes de la traite introduites dans
l'Union europ�enne � des fins d'exploitation.
[05] Highly successful environmental protection in Austria thanks to the
ecopoints system
The European Commission has adopted a report on the evaluation of the
ecopoints system provided for in Protocol No 9 to the Act of Accession of
Austria. The report highlights the major impact the system has had on the
protection of the environment as exhaust emissions have been reduced by
more than 55% compared with the 1991 level. To achieve the objective of a
60% reduction, as provided for in Protocol No 9, the Commission proposes
keeping the system in force until the end of 2003. However, the Commission
recognises that the restriction clause has had little impact on traffic
levels, and has even been counterproductive, and proposes abolishing it.
[06] Commission adopts report on application of guidelines concerning State
aid for employment
The European Commission has adopted a report on the application of the 1995
guidelines on State aid for employment. The report notes that while the
application of these guidelines has generally not been problematic, there
are certain issues which the Commission will need to take into account in
the preparation of a new text. This could be in the form of revised
guidelines to cover notified aid, but the Commission also has the option of
adopting an "exemption regulation", under which the Member States would be
exempted from notifying state aid if it meets certain criteria. The
Commission recently (6 December 2000) adopted the first three such
regulations, in the area of training aid, aid for SMEs and de minimis aid.
While it determines whether this approach is appropriate in the area of
employment aid, the 1995 guidelines will remain in force.
[07] La Commission adopte un nouvel encadrement communautaire des aides
d'Etat en faveur de l'environnement
La Commission europ�enne a adopt� un nouvel encadrement qui d�finit les
conditions dans lesquelles les Etats membres peuvent accorder aux
entreprises des aides en faveur de la protection de l'environnement. Cet
encadrement, adopt� � l'issue d'une �troite coop�ration avec les Etats
membres et les milieux int�ress�s, constitue un instrument efficace pour
d�velopper les actions en faveur de la protection de l'environnement, tout
en �vitant l'octroi d'aides d'Etat qui ne seraient pas justifi�es. Il est
aussi en totale coh�rence avec le projet de Directive du Parlement Europ�en
et du Conseil concernant le d�veloppement des �nergies renouvelables.
[08] On application by Germany, Commission decides that municipal aid for
public swimming pool is not State aid
The European Commission has held that an annual subsidy for the private
operator of an open-air swimming pool in Dorsten (North Rhine-Westphalia)
does not constitute state aid under the EC Treaty. It has therefore decided
that the aid does not have to be notified to it in advance under the aid
rules.
[09] Commission takes a negative final decision on the reduced social
contributions aid scheme in Sweden
The European Commission has concluded its formal investigation of the
Swedish Reduced social contributions scheme with a negative decision. It
considered that the reduction in social contributions granted to companies
in Northern Sweden is not in conformity with the present State aid rules.
The Commission therefore decided that the Swedish government could not
continue to implement the scheme in its present form. Competition
Commissioner Mario Monti commented : "We are well aware of the specific
problems in regions such as Northern Sweden. The Commission's decision does
not prejudice the possibility of Sweden to continue to implement the scheme
under the de minimis rule or to grant reductions in social contributions to
organisations not engaged in economic activities. If the Swedish
authorities were to modify the scheme in this sense, the effect of the
Commission's decision on most small enterprises in North Sweden could
remain limited."
[10] Commission decides aid for Zeuro M�belwerk GmbH is incompatible with
EC Treaty
The European Commission has decided that non-notified State aid totalling
euro 17.95 million and notified aid totalling euro 1.74 million for Zeuro
M�belwerk GmbH, Thuringia, are incompatible with the common market. Germany
will, therefore, have to take all the measures necessary to recover the aid
illegally granted to the firm.
[11] Commission approves aid for Kranbau K�then GmbH, Saxony-Anhalt
The European Commission has approved State aid worth DM 27.8 million (euro
14.2 million) for Kranbau K�then GmbH. The firm was granted the aid by the
Federal Office for Special Unification-related Tasks (Bundesanstalt f�r
vereinigungsbedingte Sonderaufgaben - BvS) and the Land of Saxony-Anhalt.
The funding approved will allow the firm, a maker of special cranes, to be
restructured on a sound footing after the difficulties it has got into.
Mario Monti, Competition Commissioner, emphasised : "The Commission's
decision takes special account of the difficult economic situation in the
five new L�nder. It will save more than 150 jobs in this structurally weak
area in eastern Germany."
[12] La Commission approuve des aides � la construction navale en Italie
La Commission europ�enne a d�cid� de ne pas soulever d'objections �
l'application de deux mesures italiennes d'aides visant � favoriser les
investissements des entreprises maritimes pour l'ann�e 2000. Ces deux
mesures, bien que s'adressant � des armateurs, sont toutefois consid�r�es
comme des aides indirectes aux chantiers navals conform�ment au R�glement
1540/98 du Conseil concernant les aides � la construction navale, et leur
intensit� ne peut donc d�passer le plafond de 9% de la valeur des
investissements, en l'occurrence le prix du navire.
[13] Commission approves German development aid for a shipbuilding contract
for Vietnam
The European Commission has decided not to raise objections to development
aid that Germany plans to grant for a dredger destined for Vietnam. The aid
will be used by the Vietnamese public company Waterway Dredging Company
no.1, Wadreco 1 to purchase such a vessel from a German shipyard. The
Commission found that the conditions of the relevant rules on State aid to
shipbuidling are respected.
[14] Commission investigates restructuring aid to German machine factory
Zemag
The European Commission has decided to open the formal State aid
investigation procedure in respect of aid relating to the restructuring of
Zeitzer Maschinen, Anlagen, Ger�te ZEMAG GmbH, situated in Zeitz, Sachsen-
Anhalt, Germany. The ad hoc aid subject to investigation amounts to DEM 26,
6 million (euro 13,6 million). The reasons for opening the investigation
procedure are the Commission's doubts as to the fulfilment of the
conditions laid down in the EU guidelines on State aid for rescuing and
restructuring firms in difficulty.
[15] La Commission d�cide de ne formuler aucune objection � l'encontre d'un
r�gime italien d'aides en faveur de projets de recherche-d�veloppement au
stade pr�concurrentiel
La Commission europ�enne a d�cid� de ne pas formuler d'objections �
l'encontre d'un projet de loi italien pr�voyant des aides en faveur de
projets de recherche-d�veloppement au stade pr�concurrentiel. Le projet de
loi modifie un r�gime existant, dans le cadre duquel un "Fondo Speciale
Rotativo per La Ricerca Tecnologica (F.I.T.)" avait �t� institu� en 1982.
Ce r�gime remplit les conditions fix�es dans l'encadrement communautaire
des aides d'Etat � la recherche et au d�veloppement.
[16] Commission approves Irish aid scheme "Research, Technology and
Innovation Initiative"
The European Commission has adopted a Decision approving an Irish State aid
scheme notified in September 2000 which is aimed at fostering research and
development activities throughout the country, will run until 31.12.2006
and has a total budget of euro 241 million (IEP 190 million). The scheme is
mainly targeted at small and medium-sized enterprises operating in
manufacturing and internationally traded services businesses. Support can
be requested by individual companies, but above all collaborations among
companies or involving third level colleges/research institutes are
strongly encouraged. The instrument of aid is a grant aimed at carrying out
R&D projects, which can fall in the stages of industrial research,
precompetitive development activities, and technical feasability studies.
The proposed aid intensities are in line with the aid ceilings set out in
the Community framework for State aid for research and development.
[17] Commission approves aid package for large and medium-sized firms in
the assisted regions of Flanders
The European Commission has approved two State aid schemes to support large
and medium-sized enterprises in Flanders. With this approval, the
Commission gives the green light for plans by the Flemish government to
provide financial assistance for a wide range of business aid measures in
the assisted regions in Flanders.
[18] Malpensa : la Commission donne le feu vert � la r�partition du trafic
du syst�me a�roportuaire milanais
La Commission europ�enne a approuv� le projet de d�cision sur les r�gles de
r�partition du trafic du syst�me a�roportuaire milanais, qui r�unit les
a�roports de Malpensa et Linate. Ce projet de d�cision, qui �mettait des
r�serves sur le d�cret du 3 mars 2000 en termes de proportionnalit�, prend
acte des derni�res propositions des autorit�s italiennes et conditionne son
accord � leur mise en oeuvre quinze jours apr�s la notification de la
d�cision. Loyola de Palacio, vice-pr�sidente en charge des Transports et de
l'Energie, a d�clar� � cette occasion qu'elle esp�rait "que cette d�cision
raisonnable permettra le plein d�veloppement du syst�me a�roportuaire
milanais, si n�cessaire au d�veloppement de cette partie de l'Europe, dans
le respect des r�gles communautaires � l'instar des autres grands a�roports
europ�ens."
[19] Commission authorises German State aid to the coal-mining industry for
the years 2000 and 2001
The German coal-mining industry will benefit from total State aid amounting
to DEM 9.2 billion for 2000 and DEM 8.1 billion for 2001. The European
Commission decision requires the German government to make a substantial
reduction in the amount of operating aid provided.
[20] R��quilibrage tarifaire : la Commission suspend la proc�dure
d'infraction � l'encontre de l'Italie
La Commission europ�enne a d�cid� d'interrompre la proc�dure d'infraction
contre l'Italie initi�e en 1998 au sujet du r��quilibrage des tarifs de
t�l�communications. Cette d�cision fait suite � une d�cision du r�gulateur
italien des t�l�communications d'autoriser Telecom Italia � augmenter ses
tarifs d'abonnement d'un pourcentage �gal � l'inflation +6% en 2001 afin de
les rapprocher des co�ts du r�seau d'acc�s. La cl�ture d�finitive de la
proc�dure interviendra si le r��quilibrage est effectivement achev� au 1er
juillet 2002.
[21] R��quilibrage tarifaire : la Commission adresse un avis motiv� �
l'Espagne
La Commission europ�enne a d�cid� d'adresser � l'Espagne un avis motiv�
dans le cadre de la proc�dure d'infraction commenc�e en 1998 au sujet du
r��quilibrage des tarifs de t�l�communications. L'Espagne n'a toujours pas
apport� � la Commission la preuve qu'elle s'est conform�e � ses obligations
en la mati�re. L'op�rateur Telefonica estime pour sa part supporter un
d�ficit d'acc�s �lev� du fait de l'impossibilit� de fixer au niveau ad�quat
les tarifs d'abonnement.
[22] Ouverture des march�s de l'�lectricit� � la concurrence : mise en
demeure � la Belgique
La Commission europ�enne a d�cid� d'adresser � la Belgique un avis motiv�
pour transposition incompl�te de la Directive 96/92/CE du Parlement et du
Conseil concernant les r�gles communes pour le march� int�rieur de
l'�lectricit�. Le d�lai de r�ponse octroy� � la Belgique par l'avis motiv�
a �t� fix� � deux mois.
[23] La Commission adresse un avis motiv� � la France et au Luxembourg pour
non-transposition de la directive de l'UE relative � la lib�ralisation du
march� du gaz
La Directive de l'UE relative au march� int�rieur du gaz naturel est entr�e
en vigueur le 10 ao�t 1998. Les Etats membres de l'UE ont eu deux ans pour
mettre en �uvre cette Directive qui ouvre � la concurrence le march�
int�rieur du gaz dans l'Union. Etant donn� que ces deux pays n'ont pas
r�pondu � la lettre de mise en demeure qui leur a �t� envoy�e, la
Commission europ�enne a d�cid� de leur adresser un avis motiv�. Ils
disposent d'un d�lai de deux mois pour y r�pondre.
[24] Assurance automobile Italie : la Commission saisira la Cour de justice
concernant le gel des prix
La Commission europ�enne a d�cid� de saisir la Cour de justice � l'encontre
de l'Italie concernant un gel des tarifs des contrats d'assurance
responsabilit� civile automobile. Dans leur r�ponse � l'avis motiv� notifi�
le 27 octobre (voir IP/00/1210), les autorit�s italiennes se sont born�es �
confirmer les r�ponses d�j� fournies dans le cadre de cette proc�dure (voir
�galement IP/00/773). Dans ces conditions, �tant donn� que les mesures
consid�r�es comme incompatibles avec la libre commercialisation des
produits d'assurance n'ont pas �t� abrog�es, la Commission saisira la Cour
pour faire constater le manquement (violation de la troisi�me directive
d'assurance non-vie (92/49/CEE), qui facilite la mise en �uvre du droit
d'�tablissement et � la libre prestation des services) et r�tablir la
l�galit� communautaire.
[25] Insurance : Commission refers Greece to the Court of Justice over
breakdown assistance
The European Commission has decided to refer Greece to the European Court
of Justice concerning restrictive rules that make it very difficult for non-
Greek insurance companies to offer breakdown assistance cover. In the
Commission's view, these rules represent a barrier to an internal market
for insurance and violate not only EU insurance rules, but also EU Treaty
rules on the freedom of establishment and the freedom to provide services.
The Greek authorities failed to reply to a reasoned opinion (second stage
of formal infringement procedure laid down in Article 226 of the Treaty)
requesting Greece to remove the restrictive rules in question (see
IP/00/878).
[26] Jules Muis nomm� � la t�te du Service d'Audit Interne et Koos Richelle
Directeur G�n�ral du D�veloppement
M. Jules Muis, N�erlandais, 58 ans, a termin� son mandat de Vice-Pr�sident
et Contr�leur � la Banque Mondiale en septembre 2000. Dans cette fonction,
il a rempli avec succ�s le mandat qui lui avait �t� confi�, qui consistait
en l'introduction d'un nouveau syst�me d'audit et de contr�le. Une grande
partie de sa carri�re a �t� centr�e sur le domaine de la gestion et des
standards financiers. Il a notamment �t� l'un des principaux "partners"
r�gionaux d'Ernst & Young, un des "cinq grands" de l'audit. M. Koos
Richelle, N�erlandais, 51 ans, est un fonctionnaire de haut rang,
actuellement Directeur G�n�ral au Minist�re n�erlandais des affaires
sociales. Il occupait pr�c�demment le poste de Directeur G�n�ral pour la
coop�ration internationale au Minist�re des affaires �trang�res, o� il
avait acquis une large exp�rience des questions de d�veloppement, en
particulier dans la gestion de structures et de processus complexes.

[27] Commission clears creation of Studio Channel joint venture between
Universal and NTL
The European Commission has approved an operation by which Universal Studio
Networks, one of the big Hollywood film studios, and British cable pay-
television operator NTL will jointly create a channel called The Studio
Channel which will carry second window and library catalogue films, i.e.
films which have already been shown a first time on pay-TV. The Studio
Channel will operate only in Britain and in Ireland.
[28] Commission gives go-ahead for Siemens takeover of Mannesmann
subsidiary Demag Krauss-Maffei
The European Commission has approved a merger giving German company Siemens
AG sole control of Mannesmann Demag Krauss-Maffei, Germany. Mannesmann AG
will retain an interest in Demag Krauss-Maffei through the holding company
Atecs, but will no longer have any say in the running of the business.
Demag Krauss-Maffei is active in the fields of plastics machinery, turbines,
process engineering and defence technology. The Commission concluded that
the deal would not create or strengthen a dominant market position.
[29] Starting on January 1st 2001 : New EuropeAid Cooperation Office will
improve management of external assistance
The European Commission has given its green light to the setting up of
EuropeAid Cooperation Office, a new office for the management of most of
its external assistance. Starting from January 1st 2001, EuropeAid
Cooperation Office will manage 80 per cent of the EU's external assistance,
amounting to more than euro 9 billion annually in aid projects around the
world. The launching of EuropeAid Cooperation Office is an important phase
in implementing the radical reform of the management of EU's external
assistance, decided by the Commission last May, in order to speed up
delivery and improve quality of programmes and projects.
[30] La Commission octroie plus de 1,7 million d'euros pour combattre la
fi�vre jaune en Afrique occidentale
Pour r�pondre aux d�clarations d'�pid�mies de fi�vre jaune par les
Ministres de la Sant� du Liberia et de Guin�e, la Commission europ�enne
entend financer � travers son Office d'aide humanitaire (ECHO), de
campagnes cibl�es de vaccination d'urgence pour un montant de 1,74 millions
d'euros. Ces op�rations sont mises en �uvre par les organisations non-
gouvernementales M�decins Sans Fronti�res et H�pital Sans Fronti�res.
[31] Peru : Commission approves euro 1.8 million package to support general
elections
The European Commission has approved a package of activities to support the
Peruvian general elections, scheduled for 8 April 2001. The package is
worth euro 1,749,000 and includes an EU Electoral Observation Mission (EOM)
as well as financial support to the Ombudsman Office (euro 200,000) and two
civil society organisations : "Transparencia" (euro 295,000) and "Consejo
por la Paz" (euro 85,000).
[32] Leonardo da Vinci II selection year 2000 : a successful start to the
second phase of the EU vocational training action programme
Two hundred and thirty-five projects from 28 participating countries (the
15 Member States, the 3 EEA countries and 10 candidate countries) have been
selected this year to receive an EU grant to co-finance their activities
under the Leonardo da Vinci programme. The programme promotes transnational
projects based on cooperation between the various players in vocational
training in an effort to increase mobility, to foster innovation and to
improve the quality of training. The total amount awarded to co-finance the
selected projects came to euro 81 million. More than 3500 proposals had
been submitted. Under the successful initiatives supported by Leonardo da
Vinci this year : the project "broadening access to learning, training and
employment for deaf and disabled people" aims to provide deaf people with
the skills to access education, training and work. This project, with
partners from the UK, Germany and Spain, has developed innovative methods
using the opportunities offered by new technologies. One other project,
called Linguapeace and carried out by partners from the UK, the Netherlands,
Bulgaria and Slovakia, addresses the needs of trainees, professional,
military and police servicemen, who take part in peacemaking and
peacekeeping operations under EU and UN mandates, to improve the linguistic
skills needed to facilitate these international joint operations. Proposals
can be sent in every year, in line with the time-table specified in the
call for proposals. The next deadline for the submission of proposals is 19
