  • [01] Banques - la Commission clarifie la libert� de prestation de services et l'int�r�t g�n�ral

    Une Communication qui interpr�te et clarifie, � la lumi�re de la jurisprudence de la Cour de Justice, les conditions dans lesquelles les �tablissements de cr�dit peuvent prester leurs services dans le march� unique, vient d'�tre adopt�e par la Commission europ�enne. La consultation men�e aupr�s des utilisateurs des services bancaires et des �tablissements de cr�dit a montr� que les nombreuses incertitudes qui subsistent quant � l'interpr�tation des notions "d'int�r�t g�n�ral" et de "libre prestation de services" sont susceptibles de limiter l'activit� transfrontali�re. La Communication, qui concerne particuli�rement certaines dispositions de la Deuxi�me Directive Bancaire (89/646/CEE), d�finit la port�e exacte et les conditions d'utilisation, dans le cadre de la libert� de prestation de services, de la proc�dure de notification instaur�e par la directive. Elle apporte ensuite des �claircissements quant au recours � des interm�diaires ou � l'utilisation d'installations �lectroniques. Enfin, la Communication indique que, pour �tre justifi�e au nom de l'int�r�t g�n�ral, toute mesure nationale constituant une restriction doit �tre non discriminatoire, objectivement n�cessaire et proportionn�e � l'objectif poursuivi.

    [02] Rapport annuel sur l'investissement dans les industries charbonni�re et sid�rurgique

    La Commission europ�enne a adopt� le rapport annuel 1996 sur les investissements dans industries charbonni�re et sid�rurgique de l'Union europ�enne (UE). Ce rapport refl�te les strat�gies des entreprises CECA en mati�re d'investissements pour la p�riode 1995-1999. Il d�crit �galement l'�volution des capacit�s de production de charbon et d'acier des Etats membres mise en �vidence au cours de l'enqu�te annuelle effectu�e par les services de la Commission. En 1995, les entreprises du secteur sid�rurgique ont obtenu des r�sultats satisfaisants et ont, avec des d�penses d'investissements de 3,2 milliards d'Ecus, augment� leurs investissements de 18% par rapport � 1994, pour d�passer l�g�rement le niveau de 1993 (3,1 milliards d'Ecus), en d�pit du ralentissement g�n�ral dans l'activit� �conomique. Les donn�es pour 1996 indiquent une poursuite de la tendance positive de la sid�rurgie correspondant � la reprise �conomique g�n�rale dans l'UE. Le charbon europ�en, face � la concurrence du charbon international et des autres sources d'�nergie, continue son �volution d�croissante. Seuls quatre pays conservent leurs activit�s charbonni�res dans l'UE: Allemagne, Espagne, Royaume-Uni et France.

    [03] Commission acts against Spain, Portugal, Greece and the Netherlands to curb water pollution

    The European Commission has decided to take further steps in legal actions against Spain, Portugal, Greece and the Netherlands for non-respect of European Union (EU) water legislation. The case against Spain concerns a directive on nitrate pollution from agricultural sources. The portuguese cases concern as well urban waste water as bathing water directives. The cases against Greece and the Netherlands concern a directive on water pollution by dangerous substances.

    [04] Commission decides action against Spain, Luxembourg, Greece and Belgium on waste legislation

    The European Commission has decided to pursue legal action against Spain, Luxembourg, Greece and Belgium in respect of non-application of several pieces of European Union (EU) waste legislation. The cases against Spain and Belgium concern the safe disposal of batteries to reduce the impact of battery waste on the environment. The case against Luxembourg concerns packaging waste, and the case against Greece concerns the safe disposal of hazardous waste.

    [05] Commission decides action against several Member States in relation to freedom of access to environmental information

    The European Commission has decided to take action against Portugal, Italy, Germany, Greece and Spain for non-respect of the Directive on Access to Environmental Information. European Union (EU) environmental policy recognises that citizen information and citizen participation are crucial to raising environmental awareness and to promoting best environmental practice. The directive reflects this recognition by creating a general right of access to environmental information held by public authorities.
