MILS SUPPLEMENTMILS NEWSSkopje, 17 December 1996[01] OSCE ORGANIZES ROUND TABLE FOR INTERNATIONAL RELATIONS IN MACEDONIAMacedonian Chief of State Kiro Gligorov yesterday received the commissary for national minorities of OSCE Maks Von Der Schtul at his request, reports the Macedonian Television. The Macedonian President was introduced to the aim of the high commissary visit which was the round table dedicated to the international relations in Macedonia. The round table is about to be held these days in Skopje. At the meeting many questions of mutual interest were discussed and regarding cooperation between OSCE and the Macedonian Republic the high commissary was also interested for Mr.Gligorov's estimations of the situation in the region as well as for particular issues within interior-political life during the last elections in the country.[02] OFFICIAL SUGGESTION FOR OSCE MISSION TRANSFORMATION IN MACEDONIAAt yesterday's press conference Minister Frchkovski officially brought up to the Macedonian Government the suggestion for transformation of the OSCE mission in Macedonia into a regional organization of the South Balkans with its seat in Skopje the aim of which would be monitoring the international and interethnic situations in the region. This suggestion as explained by Frchkovski arises from the fact that the OSCE mandate in Macedonia for prevention of war extension in Bosnia with the Dayton treaty and the extension of the war in Macedonia looses its sense.Frchkovski held yesterday's press conference after the 12 days Euro- Atlantic tour and he brought up assessments of the realized contacts and meetings including some important issues in the Macedonian foreign politics. Regarding the continued Greek-Macedonian talks Minister Frchkovski pointed out that besides the speculations and some new outcome predictions of the negotiating processes there are no new moments. According to the minister the situation of the negotiations is a status quo. The Macedonian position is the same - differences regarding the name could be overcome by respecting the sovereign right of any country to name itself as it believes it should be named which can not endanger neither the territorial nor any other integrity of a country and nation. Assessing his tour as a very successful one Minister Frchkovski emphasized his taking part in two important international events: the London Conference for Implementation of the Dayton Treaty in Bosnia and the Consultation NATO Meeting in Brussels. At the NATO meeting Minister Frchkovski pointed out that the Macedonian attitude about the significance of the NATO South Wing extension was brought up. Moving the strategic importance of NATO from Central and North Europe towards the Mediterranean basin zone is a necessity also expressed in the estimations of the west diplomats - underlined Minister Frchkovski - due to the possibility this region to become a `turbulent region'. The Macedonian part brought up the following attitude: after the admittance of new countries in the Alliance in June next year the process to remain open and the new country member admittance to depend upon individual conditions of each country separately. Minister Frchkovski pointed out the significant meetings with the Macedonian Diaspora in Canada as well as the talks with the Canadian Diaspora Minister Merlin Toshinski with whom he discussed migration issues. [03] REACTIONS TO KISSINGER'S ATTITUDES REGARDING THE BALKANS� SITUATIONThe opinion of Henry Kissinger for a possible 6th conflict in the Balkans regarding Macedonia stated in the interview for the Croatian weekly `Globus' is ungrounded, stated the Bulgarian Democrat Union Forces vice- president Vasil Gocev. `Sitel' TV reports, Gocev explained that according to him Macedonia and Albania are already in the sphere of interest of the US and they will not allow a new conflict in the Balkans. Gocev added that non of the neighbours is interested in the division of Macedonia.The Sofia paper `Standard' issuing comments and opinions about Kissinger's attitudes stated opinions of American experts expressed in May last year according to which the intensification of the economic and political crisis in Bulgaria may light the fuse in Kosovo and Macedonia. Regarding the Kosovo question the leader of the Kosovo Albanians Ibrahim Rugova had recently talks with American State Secretary Warren Christopher , reported Radio Tirana. Rugova stated that the best solution for Kosovo is its independence and neutrality, openness towards Albania and Serbia with a possible civil protectory. `Makpres' reports the news of Radio Tirana that Rugova asked Christopher that the US take the leading role in the Kosovo problem solving. [04] TODAY'S ROUND OF GREEK-MACEDONIAN NEGOTIATIONS UNCERTAINGreek- Macedonian talks regarding the differences about the name should be continued today in New York but as the media report it is uncertain whether the meeting will be held considering the strike of the Greek diplomatic officials. Otherwise this round of negotiations should have lasted several days, similarly to the prior one which lasted about a week. Besides numerous speculations the prior meeting in New York had not come up with any specific suggestion and all this was confirmed also by Macedonian Chief of Diplomacy Ljubomir Frchkovski.[05] REACTIVATED DEMANDS OF MACEDONIAN FIRMS FOR COMPENSATION OF IRAQI- KUWAIT WARAddressing the Compensation Commission of the UN Security Council in Geneva Macedonian Minister Ljube Trpevski urged for priority in solving the demands for compensation of the Macedonian firms from the Iraqi-Kuwait war which amounts up to 286 million dollars. Trpevski also expressed his pleasure that all individual demands for suffered damages from the War between Iraq and Kuwait of the Macedonian citizens have been accepted and there are conditions the citizens to be paid out in the following 18 months. According to announcements Minister Trpevski and Ambassador Petrevski today should meet the Secretary Executive of the Compensation Commission Carlos Aldomora.The demands in the name of the damaged firms made by the Macedonian Government to the UN Compensation Commission will be discussed at the meeting. [06] WITH `97 MICROECONOMICS POLICY - PRODUCTION AND EMPLOYMENT INCREASEAt yesterday's session the Macedonian Government established the Macroeconomics Policy of the Republic of Macedonia for the year 1997. The official announcement states: it is established that the primary tasks which will be achieved by the Macroeconomics Policy are the maintenance of the current process of the production revival and creating conditions for social product increase. There are predictions for continuing the structural reforms as a prerequisite for maintaining the established stability in the economy courses and the increased production upon permanent basis. An accent should be placed on the privatization of the businesses which were eliminated with the Law for Transformation of Firms with social capital and the organization and finance strengthening of the domestic banks. An accent should also be put on the procuring of social security for the population.With the Macroeconomics Policy for `97 conditions will be created for employment increase and for terminating the increasing number of people on the look-out for job. The Monetary Policy will be directed towards maintenance of the achieved stability and maintenance of the inflation within the predicted 2% per year which will incite economy development. Particular attention will be paid to the policy of the fiscal sector i.e. towards procuring balance in the total income and expenses. This will be realized through a higher payment of the income on all grounds and a wider and more even comprising of the tax obligations as well as severe budget limitation on the part of expenses. 1997 will be continued with liberalization of the foreign-trade exchange in accordance to the agreed principles of the World Trade Organization. The Macroeconomics Policy will aspire towards procuring proper conditions for a more remarkable growth of the export of goods and services, decrease of the import and its reduction within the frames of the real feasabilities. [07] THE PETROL MORE EXPENSIVE STARTING LAST NIGHTAccording to the decision of the Macedonian Government starting from last night the price of the oil derivatives in the Republic were increased, Now a liter of 86 octane petrol costs 36,5 denars, the 98 octane petrol costs 38,5 den. the diesel D-1 costs 24 den. the diesel D-2 costs 23 den. while the price of the non-lead petrol is not changed. The increase of the motor petrol is 2 denars per liter while of the diesel petrol it is one denar per liter. As it is stated in the Government announcement the increase the unrefined oil price at the world market since August has imposed the need Macedonia too to make a minimal correction in the prices of the oil derivatives.[08] ADDITIONAL MEANS TO THE BUDGET BY VEHICLES WITH `A-9' PLATESAccording to the decision of the Macedonian Government all vehicles in Macedonia that have the `A-9' license plate ( property to foreign citizens) should pass custom duty or otherwise they will be returned to their countries by 31st December this year. A-1 TV reports, in Macedonia 800 out of 1.000 vehicles with such plates have paid duty by now and most of them are vehicles belonging to citizens coming from the SR Yugoslavia. Until now the State Budget has cashed in 780.000 DEM. from the custom duties for vehicles with `A-9' plates and 66% are gathered in the Stopanska customhouse. With the prolongation of the Government decision on the dead line of paying the duty or alienation of such vehicles which used to be on 23rd December the Government expects additional means on that ground.[09] ELECTED MAYORS FOR TEN MUNICIPALITIESAfter yesterday's voting in round 2 of the local elections according to unofficial results given by the election commissions 1o municipalities have chosen new mayors: Ohrid - Nikola Matlievski from the Social Party, Lozovo - Blazzo Iliev from The Social Party, Izvor - Marjan Risrov from the triple coalition (VMRO-DPMNE- DP, and MAAK-KP) , Mogila - Slavko Velkovski from the triple coalition, Bach - Stevche Stefanovski from the triple coalition, Chicher- Sandevo - Borislav Kirandzich from the Serbian Democrat Party, Krivogashtani - Jane Vrtovski from SDSM, Kamenjane - Abdurvehab Ismaili from the PDP and Lipkovo - Vaib Saiti from PDP. A mayor has not been elected for the municipality Sopishte because last Sunday there was no voting in the polling stations in Chiflik and Labarovo. At the polling station Gjavato in the Bogdanci municipality the first election round was affirmed. The Court of Appeal in Skopje, reports the Macedonian Television, yesterday accepted the complaint from PDPA made due to breaching the provisions of the Local Election Law in the polling stations #2 in Tetovo and # 60 in Mala Rechica annulment by this the voting from the round 1.Also the complaint made by Sashim Demiri the independent mayor for Zzelino municipality was accepted. Due to breaching the provisions of the Local Election Law the voting in the round 2 in the polling stations Gorogle and Grupchin within the municipality Zzelino were annulled. In Probishtip after a second examination of the plead the Court of Appeal in Shtip annulled the decision of the Municipal Election Commission deciding to accept the compliant made by SDSM which negotiated for irregularities in 4 polling stations . In accordance with this decision the elections will be repeated in the polling stations in the villages Neokazi, Lozovo, Troovo and Gunovci where the voting will take place on 22nd December. [10] AFTER A LONGER PAUSE - SESSION OF MACEDONIAN PARLIAMENT TODAYThe Macedonian Parliament after a longer pause today should continue the 54- the session in which the Members should discuss the Bill for trial processes and after that the 55-th session will commence. At its schedule are the law propositions for criminal acts for carrying out sanctions and offenses and the Bill for protection and improvement of the environment and the nature. At the itinerary are the ratification of several international treaties.[11] MOC MADE DECISION FOR FORMING AN OLYMPIC POOLThe new Administrative Committee of the Macedonian Olympic Committee at yesterday's session made a decision on forming a Olympic Pool, an association of firms and individuals who will help the Olympic Committee financially. President of the Pool is the manager of the `Makedonija Tabac' company Dancho Shuturkov. It has been decided Boris Popgjorchev to be ahead of the History Commission, Dimche Belovski is responsible for international cooperation and Aleksandar Stikov for the Information Commission.Regarding contacts with the Balkans Olympic committees a forth conference in Skopje has been proposed, and support was given to the initiative for a round table meeting for the problems of the countries ` exporters of football players'. At yesterday�s MOC session it was stated that the Italian Olympic Committee has given the exclusive rights on using the doubles from the Italian football league for the Macedonian sports prognosis for which MOC will sign a contract with the Macedonian Lottery. Yesterday MOC supported the initiatives for forming an Olympic Academy as well as an Olympic Club `Pierre de Cubreten' and on the occasion of the great success of `Buchim Jaka' from Radovish in the international wrestling cup an Olympic day is to be held in Radovish sometime during next month. MILS SUPPLEMENT[12] `High mandate punishments of citizens'(`Nova Makedonia' 15 December 1996)With the judicial government reform the courts of justice and the courts of economy are continuing their possess of working within the frames of 27 fundamental courts in the country. By this the offences and the processes of punishment have gone into the sphere of the fundamental courts. This change has imposed preparation of a Offence Bill which these days is being examined by the parliamentary bodies before it definitely becomes an issue for a parliamentary debate. However, the thing that imposes the need of its immediate passing is of course the former treatment of the offences which partly fell under judicial and administrative competence. One major novelty in this Bill regards transfer of the economic breaches in the sphere of offences which means more intensified punishment responsibility regardless of the property forms. The legal concept announces four kinds of offence sanctions: punishments, offence warnings, security measures and educable measures. There are two kinds of punishments - penalties and prison punishments. The penalties amount from 1.000 to 50.000 denars for citizens and 50.000 to 300.000 denars for firms while until now they have been determined within the frames of an average salary in the Republic and amounted from 1 tenth up to 20 salaries. The penalties may become higher than the amount regulated regarding offence acts which have caused a great material damage and in that case the penalty could be 20 times higher than the one appointed in the Bill. There are also predicted prison punishments lasting from 1 up to 90 days unlike so far when it lasted in maximum 60 days. These punishments will be carried out on persons for causing body injuries, illegal proceedings, unauthorised revealing of secrets, eavesdropping, recording, prevention and distribution of printed materials, violation of the right to strike, acts against respect and honour, against marriage, family and youth, against the environment, thefts, frauds, breaking through computer systems, causing false bankrupt with illegal activities, usury. This includes the illegal acts against cultural monuments, illegal trading and endangering traffic safety. The prolonged Bill predicts mandate punishments for citizens up to 10.000 denars and up to 100.000 denars for firms. There is a proceedings regulation in cases of penalty non-payment within the frame time of 15 to 30 days after the decision effect and when the penalties are replaced with imprisonment every 1.000 denars correspond with 1 day imprisonment not longer than 60 days. The second kind of sanction is the offence warning and the third one are the measures of security under the terms predicted by the Criminal Code which corresponds with this new legal decision. This includes the prohibition on performing activity, profession, duty, prohibition on driving a vehicle, taking away objects, banishment of foreigners, compulsory medical treatment of drug addicts and alcoholics etc. The Bill also predicts punishments for minors undergoing discipline measures such as remonstrance and intensified supervision lasting 30 days up to 1 year. The Court can also take measures for custody arrest lasting up to 15 days unless the accused proves his identity. This Bill is correlated to the tax laws, the custom laws, the laws for foreign trade businesses and the Air Navigation Law all which predict mandate punishments. According to this future law framework new punishments for traffic offences are to be provided and they should be adjusted after the drafting of the law.
