SO THERE IS AMPLE HISTORICAL PRECEDENT FOR THE PRESIDENT TO SUGGEST THAT HE HAS THE CONSTITUTIONAL AUTHORITY TO GO FORWARD IN THIS MATTER WITHOUT AN EXPLICIT CONGRESSIONAL AUTHORIZATION. IT'S BEEN DONE MANY TIMES BEFORE AND IT HAS NOT BEEN EFFECTIVELY CHALLENGED AT A JUDICIAL LEVEL EITHER." I HAPPEN TO BELIEVE THAT THE WAR POWERS ACT MAY INDEED BE UNCONSTITUTIONAL BECAUSE IT DOES RESTRICT THE PRESIDENT'S ROLE AS COMMANDER IN CHIEF, WHICH IS CLEARLY STATED IN ARTICLE TWO OF THE CONSTITUTION. IT LIMITS THE PRESIDENT'S ABILITY TO USE HIS DISCRETION TO PROTECT AMERICAN INTERESTS ABROAD, AND FEW CONSTITUTIONAL SCHOLARS BELIEVE THAT THAT WOULD EVER HAVE BEEN INTENDED BY THE CONSTITUTIONAL FRAMERS."
